Digest:         A part-time judge may not serve on a Congressman’s advisory committee which recommends candidates for appointment to military academies.

Opinion:


         A part-time judge asks whether Opinion 89-132, Vol. V, of this Committee, which stated that full-time judges may not serve on a Congressman’s advisory committee to recommend candidates for military academies, also is applicable to part-time judges.


         One of the reasons stated in our Opinion 89-132 was the perception that “the congressman’s committee may be perceived as participating in a political or quasi-political function”.


         This consideration applies to part-time judges as well as full-time judges. Accordingly, a part-time judge may not serve on the committee.
