Opinion 93-110

October 28, 1993

Digest:         A judge, who is permitted to practice law, may not accept a position as standing legal counsel to a Police Chiefs’ Foundation, because such a position appears to be too close to being a member of the association, which is prohibited.

Rules:          22 NYCRR 100.2

Opinion:

A village justice, who is permitted to practice law, has been requested to serve as legal counsel to a Police Chiefs’ Association. The justice inquires whether it is permissible to accept this appointment.

It is the opinion of this Committee that the justice may not accept an appointment as standing legal counsel to the Association. It appears that this position would be too close to being a member of the Association, which the Committee has held to be impermissible. See, Opinion 92-112, Vol. X.
