Dear Justice


         The Advisory Committee on Judicial Ethics at its meeting of January 28, 1993, considered your inquiry (93-17), concerning whether you may be involved in the expansion and maintenance of a commercial property of which you are a tenant-in-common with a 25% interest.


         For the reasons set forth in our Opinion 91-108, a copy of which is enclosed, a judge may not be a managing or active participant in any form of business enterprise organized for profit. Since the property in question is a commercial property, this Committee deems Opinion 91-108 applicable to your inquiry.
