Digest:         A town justice may decline nomination by a political party; as long as it is not a quid pro quo for his or her nomination by another party, nor a condition of such other nomination.

Opinion:


         A town justice inquires whether a justice may refuse a cross-endorsement for re-election. The justice states that the political party making the primary nomination is attempting to persuade the justice not to accept cross-endorsement because it could dilute the political party's own ticket.


         As long as there is no quid pro quo and the justice's nomination is not conditioned on rejection of other party nomination, a justice may, if he or she wishes, decline other nominations.
