Digest:         A Village Justice may attend a retirement dinner held in his honor which is being given by the village police benevolent association, the judge having served previously as a village police officer.

Rule:            22 NYCRR 100.5(a)

Opinion:

A Village Justice inquires as to the propriety of attending a retirement dinner held in his honor, which dinner is being given by the local police benevolent association. The judge had served for many years as a village police officer, and his co-honoree at the dinner is another police officer who is retiring.

Based on the facts presented, the Committee is of the opinion that the judge may attend the retirement dinner.
