Opinion: 95-106

September 21, 1995

Digest:         A part-time judge should not serve as a 911 dispatcher in the county where the judge's court is located.

Rules:          22 NYCRR 100.2

Opinion:

The inquiring part-time town justice asks whether it is permissible to accept a county civil service position as a 911dispatcher in the same county where the judge presides.

In the Committee's opinion, the judge may not accept such a position. As described, the judge will clearly be involved with police work on a local basis. A judge should not be serving as a police officer or in a position so closely related to ongoing police activity.
