Digest: A judge is permitted to serve on the Board of Directors of a charitable nonprofit organization that provides services in the area of alcohol and substance abuse, subject to the limitations set forth in section 100.4(C)(3) of the Rules Governing Judicial Conduct, and provided that there are no referrals by the judge of defendants to the agency.

Opinion:

            A judge asks whether it is permissible to serve on the Board of Directors of a charitable, nonprofit agency, providing community counseling services in areas dealing with alcoholism and other substance abuse problems.

            Such service is permitted under section 100.4(C)(3) of the Rules Governing Judicial Conduct subject to the limitations provided for in the Rules and elsewhere. See e.g. Opinion 99-94. In addition, there should not be any referrals by the judge to that agency of defendants who appear before the judge.
