Digest: A full-time judge may serve on the Board of Directors of a public radio station and as an officer and board member of a private golf club, subject to the provisions of the Rules Governing Judicial Conduct.

Opinion:

            A full-time judge inquires about membership on the Board of Directors of a public radio station. The judge advises that participation involves a yearly meeting without compensation and does not entail any fund-raising activity. These activities, as described, appear to be permitted by section 100.4(C)(3) of the Rules Governing Judicial Conduct which allows a judge to act as a director of an organization which is not conducted for profit and which does not involve impermissible involvement in fund-raising.

            The judge also asks about serving as a board member and officer of a private golf club. That question has been addressed in prior opinions of this Committee, and is regarded as a permitted activity. Opinions 96-60 (Vol. XIV); 94-111 (Vol. XII).

            We further advise the judge that participation in both organizations is governed by section 100.4(C)(3) of the Rules Governing Judicial Conduct and all other provisions of the Rules that pertain to off-the-bench activity.
