02-62

April 20, 2004

This is in response to your inquiry (02-62) in which you ask whether your name may appear on stationery or other mailing pieces as a member of a committee organizing a law school alumni event. The costs of the event would be covered, in part, by funds raised through the sale of sponsorships.

Under the Rules Governing Judicial Conduct, a judge is prohibited from personally participating in the solicitation of funds or other fund-raising activities. 22 NYCRR 100.4(C)(3)(b)(i). In addition, a judge cannot use or permit the use of the prestige of judicial office for fund-raising or membership solicitation. 22 NYCRR 100.4(C)(3)(b)(iv). We enclose for your consideration Opinions 99-09 and 02-98 which deal with the issues raised in your inquiry.
