Dear Justice :

         This responds to your inquiry (09-32) in which you ask whether you may voluntarily assume certain duties such as ordering food and processing paper work currently performed by the head of a local food pantry, run by a local church. The Committee perceives no ethics prohibition to the work you describe in your inquiry.

         Enclosed for your convenience is Opinion 94-03 which relates to this issue. Please note this opinion refers to 22 NYCRR 100.5(b)(2) which has since been replaced by 22 NYCRR 100.4(C).

         As to your second inquiry regarding your co-judge, the Committee does not answer questions concerning the conduct of any judge other than the conduct of the inquiring judge him/herself.
