Opinion 89-30

         The Advisory Committee on Judicial Ethics agrees that your inquiry (89-30) is covered by previous Committee Opinion 87-25, a copy of which is enclosed.

         We conclude that there is no per se ethical prohibition to your serving as a member of the associate counsel staff to the New York State Assembly Committees on Agriculture and Commerce while also holding the part-time judicial office of town justice (22 NYCRR Section 100.5[h]).

         Should a conflict arise between the two positions you would then be obliged to comply with all pertinent Rules and Canons (see 22 NYCRR 100.3; Code of Judicial Conduct, Canon 3).
