Dear Justice


         The Advisory Committee on Judicial Ethics, at its meeting of December 11, 1990, considered your inquiry (90-179) dated November 1, 1990, inquiring under what circumstances a district attorney, who represented you in a personal matter from August, 1989, until October 1990, may appear before you.


         The Committee refers you to Opinions 88-43, 88-120, 88-125 and 88-153, copies of which are enclosed, which concern similar situations. You need not recuse yourself in matters handled by the district attorney, if you disclose your relationship with the district attorney, and all the parties consent, on the record, to your hearing the case.
