Opinion 91-153

December 5, 1991

Digest:         A part-time judge may serve on a task force of the county health department whose functions are purely educational.

Rules:          22 NYCRR §100.5(h) and (g).

Opinion:

A part-time judge asks whether it is permissible to serve on an injury prevention task force operated by the county health department, which will introduce programs such as child safety seat awareness.

Section 100.5(h) of the Rules of the Chief Administrator permits part-time judges to accept public employment in a municipal department or agency. The limitations set forth in section 100.5(g) of the Rules of the Chief Administrator prohibiting judges from joining governmental commissions do not apply to part-time judges. While the functions of the proposed task force are not made clear, the part-time judge may serve on the task force if its functions are purely educational.
