Opinion 91-24

Digest:         A judge's election committee may purchase tickets to political functions, for the judge and spouse, for six months following the   general elections.

Rules:          22 NYCRR §100.7.

Opinion:

A recently elected judge inquires whether it would be proper for the judge's campaign committee to purchase tickets to a political function, for the judge and the judge's spouse, during the six-month period following the general elections.

Section 100.7(a) of the Rules of the Chief Administrator prohibits judges from purchasing tickets for political functions. However, section 100.7(a)(1) removes the prohibition when the judge is running for elective judicial office, and for six months after the general elections, if the judge was a candidate in that election.

The judge may, therefore, have the campaign committee purchase tickets for the judge and the judge's spouse for up to six months following the general elections in which the judge participated as a candidate.
