Digest:         A part-time judge may serve as an arbitrator.

 

Rule:            22 NYCRR 100.5(e).


Opinion:


         A part-time judge asks if it is permissible to serve as an arbitrator of a private contractual dispute.


         Section 100.5(e) of the Rules of the Chief Administrator permits part-time judges to act as arbitrators "with particular regard to sections 100.1, 100.2 and 100.3 of this Part". Accordingly, the inquiring judge may serve as an arbitrator, so long as it does not interfere with judicial duties, or is otherwise improper.
