Dear Judge


         The Advisory Committee has considered your request of October 31, 1994, concerning the propriety of your co-judge on the Family Court bench hearing the adoption petition that you intend to file with respect to your adoption of your step-daughter.


         As long as the proposed adoption is uncontested, the Committee sees no objection to the matter being heard by your co-judge on the Family Court. Should that not be the case, and there is an anticipated adversary proceeding of some nature, the Committee would suggest that you apply to the Supreme Court for the adoption.
