Opinion 95-120

September 21, 1995

Digest:         A part-time judge may not accept employment as part-time police chief in a different community.

Rules:          22 NYCRR 100.5(h)

Opinion:

A part-time justice has been appointed to position of part-time police chief of a village in a different community and asks whether the holding of the two positions creates a conflict of interest.

In the opinion of the Committee the judge may not accept employment as a police chief even if that position is in a different jurisdiction. Section 100.5 (h) of the Rules of the Chief Administrator specifically bars a judge from accepting employment as a peace officer.
