Opinion 95 - 153

December 14, 1995

Digest:         A judge may provide a recommendation on behalf of the judge’s court attorney who is seeking a change in employment.

Rules:          22 NYCRR 100.2

Opinion:

A full-time judge asks whether a reference may be provided on behalf of the judge’s court attorney who is contemplating a change in employment.

This Committee has previously stated that a judge may provide such a reference, where the judge has personal knowledge of the individual’s abilities and character, and the recommendation contains such an appraisal. See e.g., Opinion 88-10 (Vol. I); Opinion 88-53 (Vol II); Opinion 90-46 (Vol. V).
