Dear Justice:


         This is in response to your inquiry of January 14,1997 (97-10) in which you ask whether you may accept an appointment to the Board of Trustees of the Gloversville Theater Corporation, a not-for-profit corporation, which serves as a regional performing arts center.


         The Committee perceives no ethical objection to your serving as a member of the Board of Trustees. However, such service must conform to the requirements of section 100.4(C)(3)(b) of the Rules Governing Judicial Conduct which precludes a judge from personally participating in the solicitation of funds and other fund-raising activities.
