Opinion 98-03

February 4, 1998

Dear:

This is in response to your inquiry (98-03) concerning the ethical propriety of a part-time judge - presumably serving in your court - also being employed as a member of the County Attorney’s Office.

It appears that your inquiry does not involve an ethical question concerning yourself. Under such circumstances, it has been the general practice of the Committee not to provide advisory opinions in response to such inquiries. The role of the Committee is to provide guidance to judges (and candidates for judicial office) who seek advice concerning their own actions and not that of other judges. Accordingly, we are not in a position to issue an opinion concerning the question you raise.

Very truly yours,

Thomas P. Flaherty

Justice of the Supreme Court

Co-Chair

George D. Marlow

Dutchess County Court Judge
