Step One – The Petition for Guardianship
The petition form you complete depends on your role.
- Are you a minor 14 years of age or older filing a petition to request the appointment of a guardian? If yes, download and complete Form 6-1-a – Petition by Person Over 14 for Appointment of Guardian of a Person or Permanent Guardian.
- OR -
- Are you an adult petitioning the court to be appointed the guardian of a minor? If yes, download and complete Form 6-1 – Petition for Appointment As Guardian of a Person or Permanent Guardian.
Step Two – The Oath and Designation for Service of Process
- Regardless of the petition type selected above, the proposed guardian must complete, Form 6-2 – Oath and Designation for Service of Process.
Step Three – Consent of Person Over 18 and Preference of Person Over 14
- Is the minor over 14 or over 18? If yes, the minor must complete the preference / consent form: Form 6-3 - Consent of Person Over 18 and Preference of Person Over 14 Regarding Appointment of Guardian.
Step Four – Waiver of Process, Renunciation, or Consent Form
- Are the parents or persons legally responsible for the youth consenting to the appointment of a guardian? If yes, they should complete Form 6-4 - Waiver of Process, Renunciation Or Consent to (Letters of Guardianship) (Standby Guardianship).
Step Five – OCFS 3909 – Request for Information (Guardianship)
- The proposed guardian must complete the OCFS 3909 - Request for Information Guardianship form (Microsoft Word download). Click here for instructions and an example of a completed form.
Step Six – Filing the Petition and Supporting Documents
Before filing, please ensure the petition and supporting documents are signed and notarized as required.
To file the petition, you have the following options:
- File electronically using our NYSCEF E-Filing system.
- File in person at the courthouse. Click here for New York City Family Court locations.
- Mail the petition and documents to us.
Reminder: guardianship petitions and supporting documents are NOT accepted via email or EDDS.
