A Separation Agreement is a contract between you and your spouse in which you agree to live separate and apart. A Separation Agreement may also address matters including but not limited to the rights of the parties, division of marital property, maintenance, custody, and child support. A Separation Agreement is not something the court grants and the court does not assist parties with the preparation of Separation Agreements. A Separation Agreement must be acknowledged by the parties before a notary and the acknowledgment must be in the form required to entitle a deed to be recorded. The preparation of a Separation Agreement can be a complex task.
