APPELLATE TERM : 9th and 10th JUDICIAL DISTRICTS

NO. 2002-1108 S CR

THE PEOPLE OF THE STATE OF NEW YORK, Respondent,

against

BRUCE GURLEY, Appellant.

Appeal by defendant from a judgment of the District Court, Suffolk County (J. Santorelli, J.), rendered July 16, 2002, convicting him of assault in the third degree (Penal Law § 120.00 [1]) and imposing sentence.

Judgment of conviction unanimously affirmed.

The information in the case at bar set forth sufficient factual allegations to satisfy the element of "physical injury" as provided in Penal Law § 120.00 (1) (see Penal Law § 10.00 [9]; People v Henderson, 92 NY2d 677, 680-681 [1999]). The other issues raised on this appeal were considered and found to be without merit.
