Defendant appeals from a judgment of the Criminal Court, New York County (William M. Harrington, J.), rendered January 5, 2005, after a nonjury trial, convicting him of sexual abuse in the third degree and imposing sentence.


PER CURIAM

Judgment (William M. Harrington, J.), rendered January 5, 2005, affirmed.

The verdict was based on legally sufficient evidence and was not against the weight of the evidence. There is no basis to disturb the court's determinations concerning credibility, including its acceptance of the
victim's testimony (see People v Gaimari, 176 NY 84, 94 [1903]).

This constitutes the decision and order of the court.
