APPELLATE TERM OF THE SUPREME COURT, FIRST DEPARTMENT

PRESENT: McKEON, P.J., DAVIS, KLEIN HEITLER, JJ
. NY County's Clerk No. 570204/05

People of the State of New York, Respondent,

against

Jerome Jamison, Defendant-Appellant.

Defendant appeals from a judgment of the Supreme Court, Bronx County (Judith S. Lieb, J.), rendered January 28, 2005, after a jury trial, convicting him of failing to register under Correction Law § 168-t and imposing sentence.

PER CURIAM:

Judgment of conviction (Judith S. Lieb, J.), rendered January 28, 2005, reversed, on the law, and accusatory instrument dismissed.

As the People commendably concede, reversal of the judgment of conviction and dismissal of the accusatory instrument are warranted because the original information failed to contain factual allegations establishing, if true, every element of the offense charged (see People v Alejandro, 70 NY2d 133, 136 [1987]). We reach no other issue.

This Constitutes the Decision and Order of the Court.
