Respondent appeals from an order of the Civil Court of the City of New York, New York County (Pam B. Jackman Brown, J.), dated January 10, 2007, which denied his motion to dismiss this holdover summary proceeding.

Inasmuch as it is now undisputed that petitioner filed a petition for administrative review of the DHCR overcharge order, this holdover proceeding was properly stayed pursuant to the so-ordered stipulation between the parties and Rent Stabilization Code (9 NYCRR) § 2529.12. THIS CONSTITUTES THE DECISION AND ORDER OF THE COURT.
