—[*1]
The Law Office of Bruce A. Newborough, P.C., Brooklyn, N.Y., for respondent.
In an action to recover damages for personal injuries, the defendant Corner Stone Baptist Church appeals, as limited by its brief, from so much of an order of the Supreme Court, Kings County (Bayne, J.), dated May 26, 2005, as denied its motion for summary judgment dismissing the complaint insofar as asserted against it.
Ordered that the order is affirmed insofar as appealed from, with costs.
There are issues of fact requiring the denial of summary judgment (see CPLR 3212; Alvarez v Prospect Hosp., 68 NY2d 320 [1986]). Rivera, J.P., Miller, Dillon and Belen, JJ., concur.
