[*1]Motion for reargument and other relief granted to the extent that, upon reargument, the ordering paragraph of the opinion and order entered July 18, 2007 (44 AD3d 135) is amended by directing that a new trial is granted on the issue of the negligence of defendant Maritza Santana, M.D. only and, if negligence is found, on the issue of damages and the last paragraph of the opinion is amended by providing that a new trial is granted on the issue of Dr. Santana's negligence only and, if negligence is found, on the issue of damages, and the motion is otherwise denied.
