APPELLATE TERM OF THE SUPREME COURT, FIRST DEPARTMENT

PRESENT: McKEON, P.J., SCHOENFELD, HEITLER, JJ

08-079.

Tina Kim, Plaintiff-Respondent, 570830/07

against

United Young Artist Foundation, Inc. and Sonia H. Yi, Defendants-Appellants.

Defendants appeal from a judgment of the Small Claims Part of the Civil Court of the City of New York, New York County (Jeffrey K. Oing, J.), entered on or about July 20, 2007, in favor of plaintiff and awarding her damages in the principal sum of $1,231.70.

Per Curiam.

Judgment (Jeffrey K. Oing, J.), entered on or about July 20, 2007, affirmed, without costs.

The judgment in plaintiff's favor achieved substantial justice between the parties in accordance with the rules and principles of substantive law (see CCA 1807).
The record supports the trial court's express finding that the e-mail communications between the parties clearly and
explicitly established the payment terms of the parties'
agreement.

THIS CONSTITUTES THE DECISION AND ORDER OF THE COURT.
