Kew Gardens Med & Rehab, P.C. as assignee of KEVIN WONG, Respondent,

against

Countrywide Insurance, Appellant.

Appeal from an order of the Civil Court of the City of New York, Queens County (Diane A. Lebedeff, J.), entered March 30, 2007. The order, insofar as appealed from, granted plaintiff's motion to enter judgment.

Order, insofar as appealed from, reversed without costs and plaintiff's motion to enter judgment denied as moot.

Plaintiff's motion to enter judgment should have been denied as moot, as judgment was entered on September 26, 2006, five months before plaintiff made its motion.

Golia, J.P., Rios and Steinhardt, JJ., concur.
