Landlord appeals from an order of the Civil Court of the City of New York, New York County (Michelle D. Schreiber, J.), entered January 16, 2008, which, in a holdover summary proceeding, denied its cross motion to disgorge settlement funds and granted tenant's motion to compel compliance with a so-ordered settlement stipulation to the extent of setting the matter down for a hearing.
