SUPREME COURT OF THE STATE OF NEW YORK

APPELLATE TERM: 2nd, 11th and 13th JUDICIAL DISTRICTS

PRESENT: : WESTON PATTERSON, J.P., GOLIA and RIOS, JJ
2007-560 Q C.

Fortune Medical, P.C. a/a/o Anna Sandoval, Respondent,

against

Countrywide Insurance Company, Appellant.

Appeal from an order of the Civil Court of the City of New York, Queens County (Diane A. Lebedeff, J.), entered March 14, 2007. The order, inter alia, denied defendant's motion to the extent that it sought to limit statutory attorney's fees to $850.

Appeal dismissed.

No appeal lies from the intermediate order as the right to appeal therefrom terminated with the entry of the judgment on April 3, 2007 (Matter of Aho, 39 NY2d 241, 248 [1976]). Accordingly, the appeal is dismissed.
Weston Patterson, J.P., Golia and Rios, JJ., concur.
