SUPREME COURT OF THE STATE OF NEW YORK

APPELLATE TERM: 9th and 10th JUDICIAL DISTRICTS

PRESENT: : NICOLAI, P.J., MOLIA and LaCAVA, JJ
2009-36 W CR.

The People of the State of New York, Respondent,

against

Joseph Buddle, Appellant.

Appeal from a judgment of the City Court of New Rochelle, Westchester County (John P. Colangelo, J.), rendered November 6, 2008. The judgment convicted defendant, upon his plea of guilty, of resisting arrest.

ORDERED that the judgment of conviction is affirmed.

We have reviewed the record and agree with defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted (see Anders v California, 386 US 738 [1967]; People v Geraghty, 286 AD2d 777 [2001]).

Nicolai, P.J., Molia and LaCava, JJ., concur.
