APPELLATE TERM OF THE SUPREME COURT, FIRST DEPARTMENT

PRESENT: McKeon, P.J., Shulman, Hunter JJ
570073/08.

The People of the State of New York, Respondent,

against

Michael Johnson, Defendant-Appellant.

Defendant appeals from a judgment of the Criminal Court of the City of New York, New York County (Karen L. Lupuloff, J.), rendered June 28, 2005, convicting him, upon a plea of guilty, of assault in the third degree, and imposing sentence.

Per Curiam.

Judgment of conviction (Karen L. Lupuloff, J.), rendered June 28, 2005, affirmed.

Application by appellate counsel to withdraw as counsel is granted (see Anders v California, 386 US 738 [1967]; People v Saunders, 52 AD2d 833 [1976]). We have reviewed the record and agree with appellant's assigned counsel that there are no nonfrivolous points that could be raised on this appeal.

THIS CONSTITUTES THE DECISION AND ORDER OF THE COURT.
