Defendant appeals from an order of the Criminal Court of the City of New York, New York County (Melissa C. Jackson, J.), dated December 9, 2009, which denied his motion, pursuant to CPL 440.10, to vacate a judgment from the same Court (Angela M. Mazzarelli, J.), rendered May 30, 1989, convicting him, upon his plea of guilty, of criminal possession of marijuana in the fourth degree, and imposing sentence.
