APPELLATE TERM OF THE SUPREME COURT, FIRST DEPARTMENT

PRESENT: Torres, J.P., Shulman, Hunter, Jr., JJ
570534/10.

The People of the State of New York, Respondent,

against

Carlos Saavedra, Defendant-Appellant.

Defendant appeals from a judgment of the Criminal Court of the City of New York, New York County (Rita Mella, J.), rendered July 31, 2008, convicting him, upon a plea of guilty, of stalking in the third degree, and imposing sentence.

Per Curiam.

Judgment of conviction (Rita Mella, J.), rendered July 31, 2008, affirmed.

Application by appellate counsel to withdraw as counsel is granted (see Anders v California, 386 US 738 [1967]; People v Saunders, 52 AD2d 833, 834 [1976]). We have reviewed the record and agree with appellant's assigned counsel that there are no nonfrivolous points which could be raised on this appeal.

THIS CONSTITUTES THE DECISION AND ORDER OF THE COURT.
I concur
