Motion by Carmine DeSantis for reinstatement to the bar as an attorney and counselor-at-law. Mr. DeSantis was admitted to the bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on July 19, 1989. By decision and order on motion of this Court dated August 2, 1999, Mr. DeSantis was suspended from the practice of law pursuant to Judiciary Law § 90 (4) (d) upon a finding that he had been convicted of a serious crime, and the matter was referred to the Honorable Norman Feiden, as Special Referee to hear and report. By opinion and order of this Court dated June 5, 2000, Mr. DeSantis was disbarred based on his conviction of obstruction of justice, in violation of 18 USC § 1505 (see Matter of DeSantis, 274 AD2d 155 [2000]). By decision and order on motion dated October 10, 2000, Mr. DeSantis's motion for reargument or for leave to appeal to the Court of Appeals was denied. By decision and order on motion of this Court dated October 27, 2010, Mr. DeSantis's motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on the respondent's fitness to practice law.
Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is
Ordered that the motion is granted; and it is further,
Ordered that, effective immediately, Carmine DeSantis is reinstated as an attorney and counselor-at-law and the Clerk of the Court is directed to restore the name of Carmine DeSantis to the roll of attorneys and counselors-at-law. Rivera, J.P., Skelos, Dillon, Angiolillo and Belen, JJ., concur.
