Motion by Kathleen Paolo for reinstatement to the bar as an attorney and counselor-at-law. Ms. Paolo was admitted to the bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on March 15, 1978, under the name Kathleen Marcel Paolo. By opinion and order of this Court dated February 17, 1987, Ms. Paolo was disbarred based on her conviction of grand larceny in the second degree, in violation of Penal Law § 155.35, a class D felony, and conspiracy in the fifth degree, in violation of Penal Law § 105.05, a class A misdemeanor, and her name was stricken from the roll of attorneys and counselors-at-law (see Matter of Paolo, 125 AD2d 1 [1987]). Ms. Paolo's felony conviction was subsequently set aside by the New York Court of Appeals (see People v Paolo, 73 NY2d 596 [1989]). By decision and order on motion of this Court dated March 21, 2011, Ms. Paolo's motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to hear and report on the respondent's current fitness to be an attorney.

Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is

Ordered that the motion is granted; and it is further,

Ordered that, effective immediately, Kathleen Marcel Paolo is reinstated as an attorney and counselor-at-law and the Clerk of the Court is directed to restore the name of Kathleen Marcel Paolo to the roll of attorneys and counselors-at-law. Mastro, A.P.J., Rivera, Skelos, Dillon and Chambers, JJ., concur.
