Writ of habeas corpus in the nature of an application to release the defendant from custody in connection with an action entitled People v Nelson, pending in the Supreme Court, Kings County, under indictment No. 46/10.

Adjudged that the writ is dismissed, without costs or disbursements.

The petitioner has failed to establish that he is entitled to relief in a habeas corpus proceeding (see People ex rel. Nizin v Schriro, 77 AD3d 692 [2010]). Rivera, J.P., Dickerson, Hall and Roman, JJ., concur.
