Appeal from an order of the Justice Court of the Town of Warwick, Orange County (Peter D. Barlet, J.), dated September 23, 2010. The order granted defendant's motion to suppress statements.


ORDERED that the order is affirmed.

After a hearing, the Justice Court granted defendant's motion to suppress evidence, concluding, in effect, that the hearing evidence was legally insufficient to establish that the state trooper had probable cause to arrest defendant. We find no basis in the record to disturb the order.

Accordingly, the order is affirmed.
