Appeal from an order of the Civil Court of the City of New York, Kings County (Reginald A. Boddie, J.), entered September 13, 2010. The order granted defendant's motion for summary judgment dismissing the complaint.


ORDERED that the order is affirmed, without costs.

For the reasons stated in Mega Supplies Billing, Inc., as Assignee of Frederick Bianchi v State Farm Mut. Auto. Ins. Co. (___ Misc 3d ___, 2012 NY Slip Op _____ [Appeal No. 2010-2841 K C], decided herewith), the order is affirmed.
