(Tri State) and Mohammad Shabbir (Shabbir) (collectively, the Tri State Defendants) to dismiss the complaint and all cross-claims pursuant to CPLR 3211(a)(7) and 3212; (2) a cross motion by defendants Rayuela and Dish 165 Inc. (Rayuela/Dish), and individual defendants Hector Sanz (Sanz), Paul Fernandez (Fernandez), and Maximo Tejada (Tejada) (collectively, the Rayuela Defendants) for an automatic stay of proceedings due to the death of Tejada or, in the alternative, summary judgment dismissing the complaint and all cross-claims; and (3) a separate cross motion by defendant CRU Mechanical & Heating Inc.
