Appeal from an order of the Civil Court of the City of New York, Kings County (Reginald A. Boddie, J.), entered September 21, 2012. The order granted defendant's motion for summary judgment dismissing the complaint.

ORDERED that the order is affirmed, with $25 costs.

For the reasons stated in Compas Med., P.C. as Assignee of Mathew Bailey v Omni Indem. Co. (___ Misc 3d ___, 2015 NY Slip Op ___ [appeal No. 2012-2678 K C], decided herewith), the order is affirmed.
