DECISION & ORDER ON MOTION

Motions by the appellant pro se on an appeal from a judgment of the Supreme Court, Kings County, rendered November 13, 2002, (1) to strike the brief purportedly filed on his behalf by Alireza Dilmaghani, as retained counsel, and (2) to enlarge the time to serve and file a supplemental brief.

Upon the papers filed in support of the motions and the papers filed in opposition or relation thereto, it is

ORDERED that the motion which is to strike the brief purportedly filed on behalf of the appellant is granted, and the brief is stricken; on or before March 25, 2005, the appellant pro se shall either (1) inform this court in writing that he has retained new counsel, (2) move for leave to prosecute the appeal as a poor person and the assignment of counsel, or (3) move for leave to proceed pro se on the appeal; and it is further,

ORDERED that on the court's own motion, the decision and order on motion of this court dated July 27, 2004, which granted the appellant's motion for leave to serve and file a supplemental brief on the appeal is recalled and vacated, and the appellant's motion is denied without prejudice to renew in the event the appellant is assigned new counsel, after said counsel files a brief; and it is further,

ORDERED that the motion which is to enlarge the time to serve and file a supplemental brief is denied as academic.
