Motion by the respondent-appellant on an appeal from an order of the Supreme Court, Westchester County, entered February 14, 2003, to enlarge the joint record on appeal by adding thereto certain documents which were part of the record on appeal in a related action entitled Riverview Partners, LP v City of Peekskill (Appellate Division Docket No. 1999-01609, 273 AD2d 455). Cross motion by the appellant-respondent for this court to take judicial notice of the record on appeal in Riverview Partners, LP v City of Peekskill, and of certain other documents, or, in the event the court declines to take judicial notice, striking the references to the subject material in the brief of the respondent-appellant, including pages 17 and 22 thereof, and to strike references at pages 30, 36, and 37 in the brief of the appellant-respondent to a certain oral ruling of the Supreme Court, Westchester County.

Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the cross motion which is to strike the references at pages 30, 36, and 37 in the brief of the respondent-appellant to an oral ruling of the Supreme Court, Westchester County, is granted, and on or before March 2, 2004, the respondent-appellant shall delete or remove from all of the copies of its brief which have been filed with this court;

(1) the last full paragraph of page 30,

(2) the last paragraph on page 36 beginning with "Finally, as noted above," and

(3) the first and second paragraphs of page 37; and it is further,

ORDERED that the motion and cross motion are otherwise referred to the panel of justices hearing the appeal for determination upon the argument or submission thereof.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the decision and order on motion of this court dated October 27, 2003, is recalled and vacated; and it is further,

ORDERED that the appeal will be heard on the original papers (including a certified transcript of the proceedings, if any) and on the briefs of the appellant, the respondent, and the Law Guardian, if any. The parties are directed to file nine copies of their respective briefs and to serve one copy on each other (see 22 NYCRR 670.9[d][1][ii]; Family Ct Act § 1116); and it is further,

ORDERED that the stenographer(s) and/or the transcription service(s) is/are required promptly to make and certify two transcripts of the proceedings, if any, except for those minutes previously transcribed and certified (22 NYCRR 671.9); in the case of stenographers, both transcripts shall be filed with the Clerk of the Family Court, and the Clerk of the Family Court shall furnish one of such certified transcripts to the appellant's counsel, without charge; in the case of transcription services, one transcript shall be filed with the Clerk of the Family Court and one transcript shall be delivered to the assigned counsel.
