Motion by the Grievance Committee for the Second and Eleventh Judicial Districts for an order: 1) suspending the respondent from the practice of law, pursuant to 22 NYCRR 691.4(l)(1)(ii), upon a finding that he is guilty of professional misconduct immediately threatening the public interest in that he made substantial admissions under oath that he committed acts of professional misconduct; 2) authorizing it to institute and prosecute a disciplinary proceeding against the respondent based upon the petition annexed to the Grievance Committee's Order to Show Cause; 3) directing that a hearing be held before a Special Referee appointed to hear and report with respect to each of the issues raised by the petition dated October 19, 2004; and 4) directing the respondent to submit an answer to the petition within 20 days. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on July 28, 1999, under the name Christopher Scott Ellerman.

Between May 7, 2004, and July 13, 2004, the respondent withdrew a total of $78,400.00 in seven unauthorized transactions from the attorney escrow account of his former law firm, LaPerna & Ellerman, P.C.
By letter dated July 20, 2004, the respondent's former law partner, Joseph J. LaPerna, Esq., notified the Grievance Committee of the respondent's misconduct with regard to the firm's IOLA account. Mr. LaPerna discovered problems when he requested printouts of bank statements to reconcile the checkbook and found two internet bank transfers, made on July 1, 2004, and July 6, 2004, which was not their practice to make. When confronted by Mr. LaPerna, the respondent admitted that he took the funds for his own use. With the respondent's cooperation, Mr. LaPerna identified seven unauthorized transactions between May 7, 2004, and July 13, 2004, totaling $78,400.00. The respondent conceded that he used part of the money to pay for his wedding on July 3, 2004, and took the remaining money for a deposit on a house.
To help cover the deficit, the respondent had his wife deliver a certified check to Mr. LaPerna, in the amount of $33,000.00, payable to the firm. The respondent claimed that he had not purchased the house and the $33,000.00 was the remainder of the monies he had taken. Mr. LaPerna deposited the $33,000.00 and an additional $50,000.00 of his personal funds into the IOLA account to insure that the clients' escrow funds were intact. Mr. LaPerna had the respondent's name removed as signatory to the accounts, he had the locks changed on the office doors to prevent the respondent's entry when Mr. LaPerna was not present, and he worked with the respondent to contact all new clients to advise them to retain different counsel. Copies of the bank statements, a promissory note in the principal sum of $45,000 from the respondent to Mr. LaPerna, and the checks that Mr. LaPerna and the respondent deposited in the IOLA account to cover the shortage were attached to the complaint.
By letter to the Grievance Committee dated September 4, 2004, the respondent admitted that Mr. LaPerna's complaint accurately set forth the facts, and he acknowledged that he had utilized escrow monies for his personal use. He advised that all of the client's monies were replaced by him and Mr. LaPerna and that he signed a promissory note to compensate Mr. LaPerna for the personal funds used to fully cover the clients' monies in the account. The respondent confirmed that none of the firm's clients was injured as a result of his wrongdoing. He fully cooperated with Mr. LaPerna to immediately advise clients to get new counsel and to close those transactions which were near to conclusion.
The respondent was deeply apologetic and remorseful. He explained that he was under extreme pressure from his spouse and "stupidly succumbed." He pleaded with the Grievance Committee to be lenient and allow him to continue to practice law to support his daughter. The respondent now works on a per diem basis for a Nassau County attorney. He has no access to escrow accounts.
The respondent also appeared pro se at an investigative hearing and testified under oath. Since graduating from law school, he has handled mostly real estate transactions. A few months after starting his own practice, he entered into partnership with Mr. LaPerna, who had been in practice for many years and was looking to retire. The firm had no employees. They opened an IOLA account in or about October 2003 to handle the real estate deposits, and both he and Mr. LaPerna were signatories on the account. The respondent handled all of the record keeping pertaining to the bank accounts and signed most of the checks.
The respondent identified check number 1083, dated June 8, 2004, made payable to Ms. Stawski in the sum of $20,000, which he used to pay part of the costs of their wedding taking place on July 3, 2004. The check was deposited into Ms. Stawski's personal checking account. His marriage took place at the Harbor Manor in Staten Island with 130 guests. Another part of the $20,000 was used to obtain a new car to replace Ms. Stawski's automobile which had blown up. On June 24, 2004, the respondent made out another check, number 1009, to Harbor Manor for $7,000 to pay the balance of what was owed for the wedding. The respondent could not recall the purpose of check number 1110, payable to himself, which was endorsed by him and deposited into his joint account with his wife.
The respondent made a final check number 1118, dated July 9, 2004, in the sum of $43,000, payable to his wife, which was intended to be the deposit on a house he planned to purchase. Ultimately he did not proceed with the transaction. He believed the check was deposited into his wife's sole savings account. He also made two internet banking transfers, one on July 1, 2004, in the amount of $3,000 and another on July 3, 2004, in the amount of $2,000, to cover the remaining costs of the wedding.
The respondent intended to slowly repay the money. He did not think that the withdrawals would be detected because there was a great deal of money in the IOLA account from the various real estate transactions. The $33,000 certified check that he had his wife bring to Mr. LaPerna to cover part of the missing monies, represents all that remained of the monies he took from the IOLA account. As of the time of the hearing, the respondent had made one payment to Mr. LaPerna of $1000 on the promissory note.
The Grievance Committee has attached to its papers, a petition dated October 19, 2004, with one charge against the respondent. The respondent was personally served with a copy of the order to show cause and the supporting papers. He submitted no response to the Grievance Committee's motion herein.
In view of the foregoing, the Grievance Committee's motion is granted, the respondent is immediately suspended from the practice of law, the Grievance Committee is authorized to institute and prosecute a disciplinary proceeding against him, and the respondent is directed to serve a written answer to the petition.

ORDERED that in the event that the case was tried to a conclusion before a jury, the stenographer shall also make, certify, and file two transcripts of the minutes of proceedings during jury selection; and it is further,
ORDERED that the Clerk of the trial court shall furnish one certified transcript of each of the proceedings set forth above to the appellant's counsel, without charge (see CPL 460.70); assigned counsel is directed to turn over those transcripts to the respondent when counsel serves the appellant's brief on the respondent; and it is further,

ORDERED that in the event an issue as to the legality, propriety, or excessiveness of the sentence is raised on appeal, or if assigned counsel cites or relies upon the probation report in a brief or motion in any other way, counsel shall provide a complete copy of such report and any attachments to the court and the District Attorney's office prior to the filing of such brief or motion; and it is further,
