Motion by the appellant, in effect, to clarify a decision and order of this court dated April 19, 2004, which determined an appeal from a judgment of the Supreme Court, Suffolk County, entered February 7, 2003, by including a provision directing the Supreme Court, Suffolk County, to render a new determination on the issue of damages to be based on the evidence previously submitted at the nonjury trial.

ORDERED that the second full paragraph on page 2 of the decision and order dated April 19, 2004, is amended by (1) deleting the period after the words "issue of damages", and (2) adding thereto after the words "issue of damages" the following ", including a new determination on the issue of damages to be based on the evidence previously submitted at the nonjury trial."
