Motion by the appellants on appeals from two orders of the Supreme Court, Queens County, dated June 10, 2004, and September 13, 2004, respectively, inter alia, for leave to reargue the respondents' prior motion, among other things, to strike portions of the appellants' brief, which was determined by decision and order on motion of this court dated February 1, 2005, for leave to appeal to the Court of Appeals if this court denies reargument, for leave to serve and file a supplemental record, and to enlarge the time to comply with the decision and order on motion of this court. Application by the respondents for the imposition of a sanction and an attorney's fee.

Upon the papers filed in support of the motion and the application, and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to reargue is granted to the extent that so much of the decision and order on motion of this court dated February 1, 2005, as struck point IV of the appellants' brief is recalled and vacated, that branch of the respondents' motion which was to strike point IV of the appellants' brief is denied, and that branch of the motion which is for leave to reargue is otherwise denied; and it is further,

ORDERED that the branch of the motion which is for leave to serve and file a supplemental record is granted; on or before May 13, 2005, the appellants shall serve and file a supplemental record containing the two memoranda of law referred to on the first page of the order dated June 10, 2004; and it is further,

ORDERED that the branch of the motion which is to enlarge the appellants' time to comply with the decision and order on motion dated February 1, 2005, is granted; the appellants' time to comply with the decision and order on motion dated February 1, 2005, by (1) serving and filing a new brief which does not contain points I, II, and III of the original brief, (2) removing from all copies of the record on appeal on file with this court pages R 231 through R242, and (3) replacing page R8 in all copies of the record on appeal on file with this court with a signed copy of the order of the Supreme Court, Queens County, dated September 13, 2004, is enlarged until May 13, 2005; and it is further,

ORDERED that the motion is otherwise denied; and it is further,

ORDERED that on the court's own motion, the respondents' time to serve and file a brief is enlarged until June 13, 2005, and the respondents' brief must be served and filed on or before that date; and it is further,

ORDERED that the application is denied without prejudice to making a motion for the same relief (see CPLR 8022[b]).

Motion by the appellant pro se for leave to prosecute an appeal from an order of the Family Court, Kings County, dated January 26, 2005, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the appeal will be heard on the original papers (including a certified transcript of the proceedings, if any) and on the briefs of the appellant, the respondent, and the Law Guardian, if any. The parties are directed to file nine copies of their respective briefs and to serve one copy on each other (22 NYCRR 670.9[d][1][ii]; Family Ct Act § 1116); and it is further,

ORDERED that the stenographer(s) and/or the transcription service(s) is/are required promptly to make and certify two transcripts of the proceedings, if any, except for those m intues previously transcribed and certified (22 NYCRR 671.9); in the case of stenographers, both transcripts shall be filed with the clerk of the Family Court, and the clerk of the Family Court shall furnish one of such certified transcripts to the appellant's counsel, without charge; in the case of transcription services, one transcript shall be filed with the clerk of the Family Court and one transcript shall be delivered to the assigned counsel. Assigned counsel is directed to provide copies of said transcripts to all of the other parties to the appeal, including the Law Guardian, if any, when counsel serves the appellant's brief upon those parties; and it is further,

ORDERED that pursuant to Family Court Act § 1120 the following named attorney is assigned as counsel to prosecute the appeal:

Appeal by Jorge Baldeon from a purported judgment of the Supreme Court, Queens County, rendered January 7, 2004. By order to show cause dated March 18, 2005, the appellant was ordered to show cause before this court why an order should or should not be entered dismissing the appeal from the purported judgment on the ground that no appeal lies from the purported judgment, as the purported judgment is nothing more than a proceeding to cause a judgment of the same court rendered November 27, 1995, to be brought to execution (see People v Crawford, 239 AD2d 515), by filing an affidavit on that issue with the Clerk of this court on or before April 14, 2005.

On the court's own motion and the papers filed on response thereto, it is

ORDERED that the appeal is dismissed, without costs or disbursements, as no appeal lies from the purported judgment, (see People v Crawford, 239 AD2d 515).
