DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, in effect, to stay enforcement of a judgment of foreclosure and sale of the Supreme Court, Queens County, dated April 17, 2000, pending hearing and determination of an appeal from an order of the same court dated April 7, 2004, and cross application by the respondent for the imposition of a sanction.

Upon the papers filed in support of the motion and the cross application and the papers filed in opposition or relation thereto, it is

ORDERED that the branch of the motion which is for a stay of enforcement of the judgment of foreclosure and sale is granted to the extent that any proceedings to evict the appellant from the subject property are stayed pending hearing and determination of the appeal, on condition that the appeal is perfected on or before June 28, 2004, and that branch of the motion is otherwise denied; and it is further,

ORDERED that in the event the appeal is not perfected on or before June 28, 2004, the court, on its own motion, may vacate the stay, or the respondent may move to vacate the stay, on three days notice; and it is further,

ORDERED that the motion is otherwise denied; and it is further,

ORDERED that the cross application is denied without prejudice to making a motion for the same relief (see CPLR 8022).

Motion by the appellant for leave to appeal to this court from an order of the Supreme Court, Richmond County, dated April 21, 2004, and to stay enforcement of so much of the order as directed the appellant to execute the documents required to complete construction of the building on the subject premises and directed the respondent to pay rent arrears pending hearing and determination of the appeal.

ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary as an appeal from the order may be taken as of right; and it is further,

ORDERED that the branch of the motion which is for a stay is granted and enforcement of so much of the order as directed the appellant to execute the documents required to complete construction of the building on the subject premises and directed the respondent to pay rent arrears are stayed pending hearing and determination of the appeal on condition that the appeal is perfected on or before June 28, 2004; and it is further,

Motion by the respondent 17 S. Fulton, Inc., on an appeal from an order of the Supreme Court, Westchester County, entered September 18, 2003, in effect, to strike portions of the appellant's appendix on the ground that it contains matter dehors the record, to direct the appellant to serve and file a supplemental appendix containing certain material, to strike the appellant's brief on the ground that it does not contain references to the appendix, and to enlarge the time of all the respondents to serve and file their respective briefs. By decision and order on motion of this court dated April 21, 2004, the motion was held in abeyance, and the matter was remitted to the Supreme Court, Westchester County, to hear and report on the issue of whether it considered (1) the reply affirmation of Joseph R. Daniels dated May 25, 2003, and the accompanying exhibits, or (2) the affidavit of Thorton J. Meacham, Jr., dated May 24, 2003, the affidavit of Wayne Charles dated May 21, 2003, and the affidavit of Gwen Lyons dated May 23, 2003, attached to the instant motion papers as Exhibit E, in rendering the order entered September 18, 2003. The Supreme Court, Westchester County, has filed its report.

Upon the papers filed in support of the motion, the papers filed in opposition thereto, and the report of the Supreme Court, Westchester County, dated May 4, 2004, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the following portions of the appendix are stricken: A10 through A11, A43 through A59, and A110 through A118, and on or before June 24, 2004, the appellant shall either (1) delete or remove from all copies of the appendix on file with this court the above-mentioned material, and serve and file a supplemental appendix containing the affidavit of Thorton J. Meacham, Jr., dated May 24, 2003, the affidavit of Wayne Charles dated May 21, 2003, and the affidavit of Gwen Lyons dated May 23, 2003, attached to the instant motion papers as Exhibit E, or (2) serve and file a new appendix on appeal that does not include the material on pages A10 through A11, A43 through A59, and A110 through A118 and that includes the above-mentioned affidavits; and it is further,

ORDERED that the appellant's brief is stricken, and on or before June 24, 2004, the appellant shall serve and file a new brief which contains references to pages in the appendix on appeal; and it is further,

ORDERED that the respondents' time to serve and file their respective briefs is enlarged until July 29, 2004, and the respondents' briefs must be served and filed on or before that date.

Motion by the appellant John N., Sr., for leave to prosecute appeals from two orders of the Family Court, Kings County, both dated March 5, 2004, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the appeals will be heard on the original papers (including a certified transcript of the proceedings, if any) and on the briefs of the appellant, the respondent, and the Law Guardian, if any. The parties are directed to file nine copies of their respective briefs and to serve one copy on each other (22 NYCRR 670.9[d][1][ii]; Family Ct Act § 1116); and it is further,

ORDERED that the stenographer(s) and/or the transcription service(s) is/are required promptly to make and certify two transcripts of the proceedings, if any, except for those minutes previously transcribed and certified (22 NYCRR 671.9); in the case of stenographers, both transcripts shall be filed with the clerk of the Family Court, and the clerk of the Family Court shall furnish one of such certified transcripts to the counsel for John N., Sr., without charge; in the case of transcription services, one transcript shall be filed with the clerk of the Family Court and one transcript shall be delivered to the assigned counsel. Assigned counsel is directed to provide copies of said transcripts to all of the other parties to the appeal, including the Law Guardian, if any, when counsel serves John N., Sr.'s brief upon those parties; and it is further,
