Motion by the appellant pro se on an appeal from an order of the Supreme Court, Westchester County, dated May 23, 2003, to waive the requirements of 22 NYCRR 670.10(g) regarding certification of the appendix on appeal. Cross motions by the respondent (1) inter alia, to strike those portions of the appendix which contain matters dehors the record, to direct the appellant to file a proper appendix, and for leave to the respondent to serve and file a supplemental appendix, and (2), to dismiss the appeal on the ground that the appellant did not serve the law firm representing the respondent on the appellant's counterclaim with the notice of appeal or request for appellate division intervention.
Upon the papers filed in support of the motion and cross motions and the papers filed in opposition or relation thereto, it is
ORDERED that the branches of the cross motions which are to direct the appellant to file a proper appendix are granted to the extent that on or before July 28, 2004, the appellant pro see shall file a supplemental appendix containing:
(A) Exhibits C, E, F, I, J, K, L, and M to the affirmation of Paula J. Warmuth dated March 27, 2003.
(B) Exhibits C, to the affirmation of Patricia W. Gurahian dated March 27, 2003.
(C) Exhibits A, B, and C to the affirmation of Dominick Sorrentino dated November 4, 2002.
ORDERED that the branch of the cross motions which is to strike portions of the appendix is granted, and pages 7, 8, 14, 18, 24, 61-63, 69, 157-158, and 172-183 are stricken, and on or before July 28, 2004, the appellant shall delete or remove the foregoing pages of the appendix; and it is further,
ORDERED that the remaining branches of the cross motions are denied; and it is further,
ORDERED that on the court's own motion, the appellant's time to serve and file a proper brief in compliance with the rules of this court (see 22 NYCRR 670.10.3) is enlarged until July 28, 2004, and the appellant shall file and serve her brief on of before that date; and it is further,
ORDERED that the motion is denied with leave to renew upon the submission of a proper supplemental appendix.
